I. Introduction

  1. These Regulations (hereinafter: "Regulations") define the rules for using the Animalhotels.com website (hereinafter: the Website) available at the website address www.animalhotels.com run by the owner of the website - animalhotels sp. z o.o. with its registered office in Łódź (90 - 318) ul. H. Sienkiewicza 72, registered in the Register of Entrepreneurs, whose registration files are kept by the District Court for Łódź-Śródmieście in Łódź, XX Commercial Division of the National Court Register under the number KRS 0000934860, REGON 520527265, NIP 7252314345.
  2. Contact with the Service Provider can be obtained using the e-mail address info@animalhotels.com

II. Definitions

  1. Reservation Acceptance - confirmation of the possibility of providing the Care Service by the Caregiver
  2. Cancellation of the Reservation - interruption of the Reservation of Services by the Caretaker
  3. Animalhotels.com - animalhotels limited liability company with its registered office in Łódź, ul. H. Sienkiewicza 72, 90-318 Łódź, registered in the Register of Entrepreneurs, the registration files of which are kept by the District Court for Łódź-Śródmieście in Łódź, 20th Commercial Division of the National Court Register under the number KRS 0000934860, REGON 520527265, NIP 7252314345
  4. Pricelist – a comparative statement of the price range of Care Service Offers
  5. Payment Service Provider - an entity providing payment services to Users as part of the Website: Stripe, Inc. based in Ireland and the United States
  6. Action - actions taken by Website Users, such as: cancellation or acceptance of the Reservation, registration in Stripe, payment for the Care Service, Completion of the Reservation, issuing an Opinion and responding to it
  7. Marketing Action - publication of a post, video, relations in social media of the Guardian.
  8. Gamification - an IT solution that uses game mechanisms, consists in earning Points and achieving subsequent Levels by Caregivers
  9. Account - User's Account within the Website, where in particular data provided by the User and opinions presented are collected
  10. Level - a specific stage reached after earning a certain number of Points
  11. Offer - an advertisement constituting an offer of hotel services for animals, which is placed on animalhotels.com by the Supplier
  12. Guardian - means the provider of the Animal Care Service and/or animals
  13. Profile - the public part of the User Account containing, among others, information about you, your experience, qualifications and/or facilities; is publicly available, also for non-logged in Users or viewers
  14. Point - a unit representing the assessment in Gamification, they are awarded for specific actions
  15. Regulations - this document with all attachments, specifying the rules for using the Website. The current version of the Regulations is available on the Website at any time.
  16. Reservation of services - means an order, purchase, payment or reservation of a Care Service
  17. Website - a website with extensive functionality available at www.animalhotels.com, maintained by the Service Provider, through which the User may use in particular from the Services
  18. Status “Paid” - a message from the Website indicating that the Owner has sent money using the Payment Service Delivery Services to the Caregiver
  19. Status "Completed" - a message from the Website indicating that the Care Service has been performed by the Caregiver
  20. Agreement for the provision of care services - a paid contract concluded between the Supplier and the Owner, the subject of which is the provision of Care Services
  21. Service - services provided electronically by the Service Provider and offered as part of the Website; These services are in particular: ordering, purchasing, paying for or booking Care Services
  22. Care Service - paid services related to the care of an animal/animals provided by the Caregiver to the Owner
  23. User - a natural person, legal person or organizational unit without legal personality, which the law grants legal capacity, using the Website
  24. Owner - a person using the Website, owner of an animal/animals who is interested in the Care Service
  25. Reservation completion - performance of the Care Service by the Caregiver

III. General provisions

  1. The terms of use of the Website are set out in the Regulations. Each User of the Website is obliged to read the Regulations.

IV. The scope and nature of the services provided

  1. Animalhotels.com grants Users access to the Website enabling establishing contact between the Owner and the Guardian in order to conclude contracts for the provision of Care Services.
  2. Animalhotels.com is not a party to any agreements between the Owner and the Caregiver and therefore does not bear any responsibility towards Users for Care Services.
  3. Animalhotels.com provides Users with, among others: the following Services: enabling the use of the Account, providing a search engine for Carers, enabling booking Care Services, concluding Care Agreements, enabling Users to publish opinions about Caregivers and Care Services.
  4. Animalhotels.com does not take responsibility for the owners' negligence in the Reservation of Care Services.
  5. As part of the Website, the Guardian may offer various types of Care Services.
  6. Animalhotels.com does not employ Owners and/or Guardians.
  7. The Owners are responsible for evaluating the Guardian who performed the Care Service. The owner should personally assess whether the Keeper meets the required criteria for animal care.

V. Technical requirements

  1. The use of the Website depends on the User having a device with Internet access, such as a PC, laptop or mobile device such as a tablet or smartphone, equipped with an updated operating system and one of the following updated browsers: Edge, Chrome, Firefox, Opera or Safari with Javascript enabled, Internet connection with a bandwidth of at least 256 kbit/s.
  2. Animalhotels.com is not a provider of data transmission services. The costs of data transmission required to run and use the Website are covered by Users on their own, based on separate agreements concluded with telecommunications operators or other Internet access providers.

VI. Terms of use of the Website

  1. The User confirms that he has read and accepts the content of the Regulations and the Privacy Policy, which is available at:
  2. The User undertakes to use the Website in a manner consistent with the law and its intended purposes.
  3. The User undertakes:
    • not to take actions that contradict and/or hinder the operation of the Website
    • not to publish materials that insult honor, dignity and business reputation, promote violence, pornography, drugs, weapons, any kind of hostility or hostility for any reason, contain calls for illegal or unlawful acts, advertise the provision of intimate services;
    • not to use the Website for purposes that are unlawful or not provided for in the Regulations;
    • immediately notify Animalhotels.com of any violation (or threat of violation) of their rights or the rights of third parties in connection with the use of the Website. Any notifications should be reported to the Service Provider via e-mail to the e-mail address: info@animalhotels.com
    • It is forbidden to use the Animalhotels.com Services in order to organize the provision of Care Services with another User, and then carry out transactions regarding these services outside the Website.
  4. It is forbidden to:
    • posting content that is vulgar or contains profanity, or content generally considered offensive;
    • delivery of malware;
    • interfere in any way with the content and appearance of the Website;
    • posting content that violates the rights of third parties, including intellectual property rights;
    • posting content that undermines the good name or reputation of Animalhotels.com;
    • spamming or advertising other services;
    • publishing opinions not based on own experience, untrue or violating the Regulations;
    • posting false information in the Profile, during registration and when using the Website;
    • arranging the care of exotic, dangerous, endangered, venomous as well as horses or other farm animals or animals that have a history of attacking people;
    • post reviews about Caregivers that are not based on the Owners' personal experience, that are intentionally inaccurate or misleading, or that violate these Rules;
    • post "spam" or other unauthorized commercial communications;
    • transfer or unauthorized use of your account on the Website by any other person, or engage in fraudulent transactions.

VII. Registration

  1. In order to use the full functionality of the Website, the User is obliged to have an active Profile. User registration enables the creation of an Account.
  2. The User may only be a natural person with full legal capacity, a legal person or an organizational unit without legal personality, to which the law grants legal capacity. In the case of legal persons and organizational units without legal personality, only a person authorized to act on behalf of these entities may create an Account on their behalf and perform any activities on the Website.
  3. The User is obliged during the registration process and when using the Website to provide true, correct and up-to-date data, which he/she is authorized to use. The user is obliged to update the data in the event of a change.
  4. After correctly completing the registration form, the User will receive a message from the Service Provider via notifications with a code that will confirm the entered data. After positive verification of the data by the User, the completion of the registration process will be confirmed, after which the User will be able to log in to the Account.
  5. User registration is free and can only be done via the Website.
  6. The User may have only one Account on the Website.
  7. The User may not give anyone the password and login to his account on the Online Store, as well as log in using the data of another User.
  8. The User understands and agrees that he is fully responsible for the activities on the Profile and is obliged to inform Animalhotels.com of any unauthorized access to it.
  9. Upon confirmation of the registration procedure by the User, an Agreement for an indefinite period is concluded between Animalhotels.com and the User, unless the User has not met the conditions required by the Regulations. Then there is no contract.
  10. In the event of deactivation of the provided mobile phone number, the User agrees to immediately update his/her Profile information to ensure that messages will not be sent to the person who obtained the User's old number.
  11. The User accepts that Animalhotels.com will have access to the data and information provided on the Website by the User.
  12. Personal data is processed in accordance with the Animalhotels.com Privacy Policy available at Privacy policy

VIII. privacy policy

  1. Animalhotels.com respects your privacy. Please see our Privacy Policy and GDPR for more information at Privacy policy
  2. The administrator, within the meaning of the GDPR, of the personal data of the Owners who made an inquiry about the Care Service is the Caregiver. In order to enable the provision of the Operator's Services, it is necessary to entrust Animalhotels.com with the processing of the Owners' personal data by the Supervisor. If the Guardian does not conclude a Contract for the Provision of Care Services as part of his professional or business activity, he is not obliged to comply with the provisions of the GDPR.
  3. In particular, as part of the Website and Services, Users will use the functionality of the Website (e.g. notifications, sending messages), and Animalhotels.com will process the Owner's data on behalf of the Caretaker under the conditions set out in this data processing entrustment agreement personal data, while the Guardian remains the administrator of these personal data.
  4. As part of the provision of Services to the Guardian, Animalhotels.com processes these personal data at the request of the Guardian. Upon conclusion of the Agreement, the Keeper entrusts Animalhotels.com with the processing of the Owners' personal data (entrustment agreement).
  5. The Service Provider declares that it has appropriate measures, including appropriate safeguards, enabling the processing of personal data in accordance with the provisions of the GDPR and ensures that it takes all measures required under Art. 32 of the GDPR and meets the requirements set out in art. 28 GDPR.
  6. Animalhotels.com processes personal data only at the documented request of the Guardian - which also applies to the transfer of personal data to a third country or an international organization - unless such an obligation is imposed on the Service Provider by Union law or the law of a Member State to which the Service Provider is subject; in this case, before the processing begins, the processor informs the Supplier of this legal obligation, unless this law prohibits the provision of such information due to important public interest.
  7. Animalhotels.com ensures that persons authorized to process personal data have committed themselves to secrecy or are subject to the relevant statutory duties and secrecy;
  8. Animalhotels.com takes all measures required under Art. 32 of the GDPR and complies with the terms of use of the services of another processing entity, referred to in art. 28 sec. 2 and 4 GDPR.
  9. Animalhotels.com, taking into account the nature of the processing, helps the administrator, if possible, through appropriate technical and organizational measures to meet the obligation to respond to the requests of the data subject in the exercise of his rights set out in Chapter III of the GDPR.
  10. Animalhotels.com, taking into account the nature of the processing and the information available to it, helps the administrator to fulfill the obligations set out in art. 32-36 GDPR.
  11. Animalhotels.com may entrust the processing of personal data entrusted by the Caregiver to other entities in order to implement the functionality of the Website and as part of the internal processes of servicing Caregivers, including in particular: the supplier, the SMS operator, the e-mail operator, the programming company, service providers for sending e-mails, accounting, law firm, entities providing cloud solutions and other solutions used by Animalhotels.com in its current activity, which involves the processing of personal data (general consent of the administrator).
  12. Animalhotels.com will inform the Keeper of any intended changes regarding the addition or replacement of other processing entities, at least 7 (seven) working days before the planned start of processing by another processing entity, thus enabling the Caregiver to object to the use of another processing entity by the Keeper processing. In the absence of such an objection, it is considered that the Guardian has agreed to the change.
  13. Termination of the contract for entrusting the processing of personal data will result in the inability to provide Animalhotels.com Services under the Agreement for the Guardian, to the extent that data processing is required, the administrator of which is the Guardian. Animalhotels.com, after the end of the provision of services related to processing, depending on the decision of the Guardian, deletes or returns to him all personal data and deletes all existing copies, unless Union law or Member State law requires the storage of personal data.
  14. Animalhotels.com provides the Guardian with all information necessary to demonstrate compliance with the obligations set out in the personal data processing agreement and enables the Guardian to conduct audits, including inspections, and contributes to them, with the proviso that the Guardian is obliged to notify in advance about the planned audit, with at least 7 days in advance.
  15. Animalhotels.com immediately informs the Guardian if, in his opinion, the instruction given to him constitutes a violation of this Regulation or other provisions of the Union or a Member State on data protection.
  16. Animalhotels.com is not responsible for the legality of the personal data obtained by the Guardian or for the compliance of its activities with the GDPR. Animalhotels.com may provide the Caregiver with instructions or its own opinion in this regard, but it is not binding for both Animalhotels.com and the Caregiver, in particular it does not extend the scope of the Caregiver's Services and the Care Service Agreement.
  17. Animalhotels.com exhaustively responds to each inquiry of the Guardian related to data processing within 3 (three) business days from the date of delivery of the inquiry.
  18. Animalhotels.com undertakes to report violations related to data processing to the Supervisor. In particular, Animalhotels.com undertakes to immediately, but not later than within 36 (thirty six) hours from the moment of receiving the information, inform the Guardian of any events that may result in its liability as an administrator, on the basis of generally applicable provisions related to the protection of personal data.
  19. In the case of processing the entrusted personal data outside the EU, the Service Provider will provide the Guardian with a copy of documents that are a premise for the legality of this action (e.g. a document of standard contractual clauses in force in the contract with the so-called sub-processor).

IX. Map Terms of Use

  1. Using the Website requires the use of OpenStreetMap functions and content.
  2. The use of OpenStreetMap is subject to the current additional terms of service at [https://openstreetmap.org.pl/o-openstreetmap/wyzysknie-mapy/warunki-licencyjne/](https://openstreetmap.org.pl/o -openstreetmap/usage-maps/license-terms/) and the Copyright Policy https://www.openstreetmap.org/copyright/pl.
  3. By using the Website, the User confirms and accepts the terms of OpenStreetMap to the extent they apply to Users.
  4. Any unauthorized use of OpenStreetMap features and content may result in suspension or termination of the use of the Website.

X. Intellectual Property Rights

  1. Animalhotels.com has all intellectual property rights to the Website and their individual elements, therefore using the Website in a manner or for purposes inconsistent with the Regulations or the provisions of generally applicable law is not allowed and results in the User's liability towards Animalhotels.com.
  2. Using the Website does not grant the User any license or right to use any trademarks on the website.
  3. You may not copy or transfer any texts, photographs, trademarks, service marks, except for content from Users, except for using them on your computer for private and non-commercial purposes. All copyright, trademark, and any other proprietary rights notices must appear on all copies that you print or otherwise create.
  4. The User declares that he has all rights, including proprietary copyrights, to the content, and that the use of this content will not infringe the rights of third parties
  5. The User declares that his rights do not threaten and do not infringe the rights of third parties, in particular, they do not infringe their property and personal copyrights, and ensures that he has satisfied, or will satisfy, all rights related to them until the date of posting the content on the Website third parties in connection with the content of these materials.
  6. The User declares that in the event of a third party making claims arising from the violation of the rights set out above, he will compensate Animalhotels.com for the costs incurred in connection with making claims for damages against him, releasing the Service Provider from any obligations that arise in this respect.
  7. As soon as the content is made available, Animalhotels.com grants Animalhotels.com a free, non-exclusive, territorially unlimited license for the duration of the Agreement with the possibility of its extension, to use the User's content, along with the right to sublicense ("License").
  8. All copyright, trademark, and any other proprietary rights notices must appear on all copies that you print or otherwise create.
  9. Other products, services or designations of entities on the Website belong to the Suppliers and may be presented on the Website for identification purposes only. You should contact the relevant Providers regarding such designations and their Registration status.

XI. Reservations

  1. Owners and Service Providers conduct transactions with each other when both agree to a reservation that specifies fees, period, cancellation policy and other conditions for the provision of Services through the reservation mechanism available on the Website ("reservations").
  2. The booking can be initiated by the Caretaker or the Owner by selecting the type of Service to be provided and then following the instructions on the screen.
  3. The Owner initiates the Reservation of Services, agrees to pay for the Care Services in the Reservation after clicking the "Reserve" button.

XII. Payments

  1. The Website concludes an agreement with the Payment Service Provider for the processing of online payments and for storing Users' data regarding information on credit cards, debit cards or other payment methods offered on the Website.
  2. The User will be informed on the Website in a visible manner about the current price of the selected Services each time, including the current amount of the Remuneration for the Service.
  3. Using the payment services available on the Website involves establishing a separate legal relationship with the Payment Service Provider and accepting its regulations (available at: [https://stripe.com/en-pl/privacy](https:// stripe.com/en-pl/privacy); https://stripe.com/en-pl/legal). The Website is not a party to such a relationship and it is not possible to interfere with its content or manner of implementation. In the event of any problems with the payment, the User should contact the Payment Service Provider to clarify doubts or submit a complaint. The Website does not assume responsibility for the implementation of the payment service by an external service provider.
  4. The Payment Service Provider may process such data as: bank account number, name, surname, company name, company identification number, date of birth, e-mail address, telephone number, registered and/or residence address, credit or debit card number and other data for the proper functioning of the services offered.
  5. To confirm personal data, the Payment Service Provider may request a scan of the User's ID card.
  6. The Care Service is a transaction between the Owner and the Provider.
  7. The payment for the Care Service is made using a credit card, debit card or other payment method that is offered on the Website.
  8. The amount due for the Care Service is kept on the escrow account operated by the Payment Service Provider. With the start of the transaction, the Payment Service Provider collects funds from the Owner for the Provider and stores these funds in an escrow account until their withdrawal.
  9. The payment of the amount due for the Care Service takes place immediately on the last day of the Care Service and is paid by the Payment Service Provider directly to the Provider's bank account without additional fees.
  10. The Website does not offer any payment services, does not participate in the payment process and is not responsible for the information provided by Users within the scope of applicable law.
  11. Users are responsible for providing true details of credit cards, debit cards or other payment methods offered on the Website.
  12. The use of the services provided by the Payment Service Provider is allowed only on its own behalf. Use by third parties is prohibited.

XII. Fees

  1. Owners may purchase the Care Service by making a Reservation as described in point X.
  2. Upon acceptance of the Reservation, the Owner concludes a transaction with the Supplier and agrees to pay all fees indicated in the Reservation. The transaction must be completed before the date of commencement of the Care Service.
  3. The total amount that the Owners are charged for the Reservation also includes the service fee for the Website.
  4. The Owner agrees to pay a service fee as part of the Reservation and it is charged for each Reservation.
  5. The service fee is 10% and is calculated as a percentage of the fees for each Reservation.
  6. When the Owner pays for the Care Services, the Owner will be required to provide the Payment Service Provider with valid, current payment card details or other payment information and keep this payment information (or other acceptable alternative payment method) recorded in the Account, unless there are any outstanding , confirmed reservations.
  7. The role of Animalhotels.com is to facilitate payments from Owners to Suppliers.
  8. The owner is responsible for keeping payment information up to date.
  9. If the Payment Service Provider cannot charge the Owner on time because the payment information is no longer valid and/or the payment is not received on time, neither the Service Provider nor the Provider will be liable for any failure to perform the Care Services.
  10. In case of cancellation or complaint, the entire rate set in the Booking is returned.

XIII. Complaints regarding the operation of the website

  1. Any complaints regarding the incorrect functioning of the Website should be reported to animahlotels.com via e-mail to the following address: info@animalhotels.com. Animalhotels.com reserves the right to request information or explanations from the advertiser in a situation where it is required to recognize the complaint.
  2. The complaint will be considered within 30 calendar days from the date of its receipt.
  3. The response to the complaint will be sent to the e-mail address provided in the complaint.

XIV. Complaints about Care Services

  1. Complaints regarding non-performance or improper performance of the Care Service should be addressed directly to the Caregivers.
  2. The Caregiver is responsible to the Owner for considering complaints regarding the Caregiver's Services in accordance with generally applicable laws.

XV. Cancellation

  1. The Owner who wants to cancel the Reservation should use the mechanisms available on the Website.
  2. For the purposes of the terms and conditions contained in this section, the date of cancellation is the date of cancellation by the User via the Website, regardless of any separate communication between Users outside the Website.
  3. If the Owner cancels the Reservation before the Care Service period specified in the Reservation, Animalhotels.com will refund the fees in accordance with the cancellation policy. Animalhotels.com initiates refunds through the Payment Service Provider.
  4. The cancellation rules described in these Regulations may apply in the event of situations beyond the control of the Carers and/or Owners, which prevent the provision of the Care Service on the terms agreed in the Booking, such as evacuation, earthquakes, hurricane, fire, flood, war, riots, flooding, serious illnesses, accidents, breakage, non-compliance of dates or other similar events that prevent the provision of the Care Service.

XVI. Opinions

  1. The Website may provide the opportunity to leave a subjective opinion about Caregivers and their Care Services.
  2. The opinion may not violate the provisions of generally applicable law, in particular it may not contain: profanity, content that is untrue, defamatory or constitutes an act of unfair competition, advertising content, data of Users or other natural persons, content infringing the rights of third parties, including including intellectual property rights, good manners, personal rights, including the good name, reputation of other Users or third parties, content that is untrue, defamatory or constitutes an act of unfair competition.
  3. It is forbidden to publish opinions about the Carers that are not based on the personal experience of the Owners, that are intentionally inaccurate or misleading, or that violate these Rules.
  4. The Service Provider is not obliged to provide Content Providers with any opinions about them sent by other users of the Website, both before and after closing the account on the Website.
  5. The Guardian has the option of adding a reply to a given Opinion. Feedback rules apply to responses.
  6. Animalhotels.com is not responsible for any removal, disclosure, loss or modification of these reviews.
  7. Animalhotels.com reserves the right to review and remove these opinions from the Website at any time, which in the opinion of Animalhotels.com are contrary to the Regulations or the law. Deleting a review is irreversible.

XVII. Newsletter

  1. The Newsletter subscription service is provided free of charge by the Service Provider to Users who voluntarily and optionally agree to it.
  2. Newsletter subscription is ordered through the appropriate form available on the Website.
  3. Upon confirming the activation of the Newsletter, an Agreement for the provision of the Newsletter service is concluded between the User and Animalhotels.com for an indefinite period.
  4. The User may terminate the contract for the provision of the Newsletter service at any time by deactivating the subscription. Resignation from the Newsletter takes place by sending a declaration of will to the address info@animalhotels.com or via the appropriate link in the footer of each message sent as part of the Newsletter.
  5. Consent to receive commercial information sent by means of electronic communication is voluntary and the User may withdraw it at any time.

XVIII. Gamification

  1. The website uses a game mechanism, hereinafter referred to as Gamification.

  2. Gamification on the Website includes earning Points for Actions taken by the Caretaker. Points are also awarded for the Owner's actions for the Caregiver. Points are awarded to the Guardian.

undefined4. The Guardian may earn additional Points for Marketing Activities. The guardian may undertake such actions up to 3 times. The Guardian will earn a maximum of 3,000 Points in total. 5. Awarding Points is public. The Guardian has the option to see the history of the Points awarded in his Account. 6. By gaining a certain number of Points, the Guardian gains new Levels.

undefined7. Awarded Levels are public. Each User of the Website has the opportunity to see what Level the Caregiver has.

  1. The Website may contain links to third party websites or resources.

XX. Change of regulations

  1. Animalhotels.com reserves the right to change the Regulations at any time.
  2. Amendments to the Regulations will be published in the form of a consolidated text along with information about their implementation on the website www.animalhotels.com.
  3. Animahotels.com will notify the User about changes to the Regulations via e-mail sent to the e-mail address or via SMS to the number associated with the User's Account, 15 days before their entry into force.
  4. Animalhotels.com may amend the Regulations without observing the 15-day period referred to above, including with immediate effect, if: it is subject to a legal obligation under which it is obliged to amend the Regulations in a way that prevents its complying with the aforementioned 15-day notice period, must, by way of exception, amend the Terms and Conditions to counter an unforeseen and imminent threat related to the protection of online intermediation services, Users against fraud, malware, spam, data breaches or other threats.
  5. The User may not accept the amendments to the Regulations and in such a case request removal of the Account by submitting an appropriate statement within 15 days from the date of notification of the amendment to the Regulations. In the absence of such a request, it is assumed that the User has accepted the changes without reservations.
  6. Unless otherwise agreed, all changes to these Regulations apply to all Users, including users who started using the Website before the introduction of these changes.

XXI. Termination of using the Website

  1. Animalhotels.com may terminate this Agreement resulting from these Regulations at any time by informing the User about it in writing (also by e-mail) and/or if the User has an account, canceling his account and access to his account.
  2. The User may terminate this Agreement resulting from these Regulations at any time by deleting his account or ceasing to use the Website.

XXII. Final Provisions

  1. In matters not covered by these Regulations, the relevant provisions of Polish law shall apply.
  2. Nothing in these Terms and Conditions makes either party an agent or representative of the other party, or establishes a joint-venture or partnership relationship between the parties.
  3. The User may not transfer or assign his rights and obligations under these Regulations.
  4. Animalhotels.com may transfer the rights and obligations arising from these Regulations, without recognizing this transfer as a change to the Regulations and without prior notification to the User, provided that his rights under these Regulations are not violated.
  5. In the event that any of the provisions of these Regulations are deemed invalid or ineffective, the remaining provisions remain in full force and effect. Invalid or ineffective provisions of these Regulations will be replaced with provisions valid in the light of law and fully effective, as well as the closest to it.
