X. Intellectual property rights

- The User declares that they hold full rights to the content they publish and that it does not infringe any third-party rights.
XI. Mechanism for matching and displaying Caretakers
- During the booking request process, the Website and/or Application may use a sorting mechanism based on the Algorithm that allocates points to Caretakers. The Algorithm is designed to promote reliable and responsible Caretakers.
- The number of points allocated to a Caretaker may depend, in particular, on:
- prior activity and history of responding to booking requests,
- the quality of Care Services, including reliability in fulfilling Bookings,
- the degree of verification and completeness of the Caretaker’s Profile,
- economic parameters related to Bookings,
- additional elements related to the Caretaker’s development and credibility within the Website and/or Application.
- The Algorithm is based on a mathematical model intended to propose Caretakers best matching the Owner’s criteria while demonstrating the highest reliability and responsibility.
- The Website and/or Application may display to the Owner up to five Caretakers matching the criteria, who additionally achieved the highest Algorithm score and made a decision (accept or defer) the fastest.
- The Algorithm supports the matching process and does not guarantee that any particular Caretaker will be selected by an Owner.
- The Algorithm may be optimised and modified on an ongoing basis to improve matching quality and User safety.
- The Owner may see only a limited number of Caretakers selected by the Algorithm, even if more Caretakers meet the criteria. Other Caretakers may be queued based on the Algorithm and response time. If a Caretaker is rejected by the Owner or withdraws during the process, the Owner may be presented with the next Caretaker in the queue.
- A Caretaker may defer their decision (except for an individual request) for a period from 1 to 6 hours. During the deferral period, the Caretaker may be marked with a special icon and visible to the Owner, but messaging may be disabled. If the deferral period expires without a decision, the request may be treated as rejected.
- Lack of response within a specified time, lack of Stripe activity, cancellation of a Booking, or lack of completed courses/training (if applicable) may reduce a Caretaker’s score and visibility in future requests.
XII. Bookings
- Owners and Caretakers engage in transactions with each other when both parties agree to a Booking, which sets out the fees, period and other terms and conditions for the provision of Care Services through the booking mechanism available on the Website and/or Application.
- Each Owner shall have an active Account on the Website and/or Application to search for a Caretaker.
- A Booking may be initiated by the Owner by submitting a request after filling in: location, date, type of pet, and Amenities. The Owner must also provide pet information such as name, breed/species and, where necessary, additional information (if not provided earlier). After selecting "Start", requests are sent to Caretakers who meet the criteria; Caretakers decide whether to accept, reject, or (where available) defer.
- A Booking may also be initiated by the Owner, who directs a request to one selected Caretaker. To start the process, the Owner completes the details regarding the location, date and type of pet, as well as information about the pet (name, breed/species and any additional details, if they have not been provided earlier).
- After clicking the “Start” button, the request is sent to the selected Caretaker. The Caretaker may accept or reject the request;
- The Caretaker has 24 hours to make a decision. If the Owner changes a request addressed to one Caretaker into a request addressed to all Caretakers, the rules set out in Section XI of the Terms and Conditions shall apply;
- The Owner receives a notification of the Caretaker’s decision. In the event of acceptance, both parties may communicate via the Website and/or Application.
- The Owner may also initiate a request to multiple Caretakers meeting the criteria by selecting Amenities and selecting "Start".
- After reviewing Caretakers, the Owner selects a Caretaker and makes payment for the Care Service using the available online payment methods.
- The Booking is created when the Owner completes payment by selecting "Book and Pay" (or an equivalent button). At that moment, a Care Service Agreement is concluded between the Owner and the Caretaker.
- Care Services may be provided by natural persons and by business entities. Where Care Services are provided by a natural person, civil law rules apply; where provided by a business entity, consumer protection rules may apply where the Owner qualifies as a consumer.
- Where Care Services are performed at the Caretaker’s address, the Caretaker consents to sharing that address with the Owner for the purpose of performing the Care Service. Where Care Services are performed at the Owner’s address, the Owner consents to sharing that address with the Caretaker for the purpose of performing the Care Service.
XIII. Payments
- The Website and/or Application concludes an agreement with the Payment Service Provider for the processing of online payments and for storing Users' data regarding information on credit cards, debit cards or other payment methods offered on the Website and/or Application.
- The User shall be visibly informed via the Website and/or Application each time of the current price of the selected Services.
- The use of payment services available on the Website and/or Application involves establishing a separate legal relationship with the Payment Service Provider and accepting its terms and conditions (available at: https://stripe.com/privacy; https://stripe.com/legal/ssa). The Website and/or Application is not a party to such a relationship and has no ability to interfere with its content or the manner of its performance. In the event of any payment-related issues, the User should contact the Payment Service Provider in order to clarify any doubts or submit a complaint. The Website and/or Application does not assume responsibility for the performance of the payment service by an external service provider.
- The Caretaker is required to have an Account with the Payment Service Provider. Registration of an Account with the Payment Service Provider is possible via the Website and/or Application. The Account with the Payment Service Provider enables transactions between the Owner and the Caretaker. In order to confirm personal data, the Payment Service Provider:
- may require a scan of an identity card from Users registered before version 3.2.0 of the Website and/or Application;
- will require a scan of an identity card from each User registered after version 3.2.0 of the Website and/or Application.
- If the Caretaker's personal data requires confirmation, the Payment Service Provider may withhold payments to the Caretaker until verification is completed. The Payment Service Provider informs the Caretaker via email used for the Stripe account.
- The Payment Service Provider may process data such as: bank account number, first name, last name, company name, company identification number, date of birth, email address, phone number, registered and/or residential address, credit or debit card number and other data necessary for the efficient operation of the offered services.
- The Care Service is a transaction between the Owner and the Caretaker.
- Payment for the Care Service may be made by available methods displayed in the Website and/or Application, including (depending on availability): credit card, debit card, Przelewy24, BLIK, Apple Pay, Google Pay, Klarna.
- The amount due for the Care Service is held in a restricted (escrow-like) account operated by the Payment Service Provider. Once the transaction has been initiated, the Payment Service Provider collects the funds from the Owner and holds them until payout.
- Payout to the Caretaker takes place immediately on the last day of the Care Service at 12:00 UTC and is paid by the Payment Service Provider directly to the Caretaker’s bank account without additional charges by the Website and/or Application.
- The Website and/or Application does not offer payment services and does not participate as a payment provider; it is not responsible for the information provided by Users within the scope of the applicable law.
- Users are responsible for providing true payment details.
- The User may only use the services provided by the Payment Service Provider on their own behalf. Third party use is prohibited.
XIV. Fees
- Owners may purchase a Care Service by making a Booking as described in Section XII Bookings. The amount of the fee is determined individually by each Caretaker.
- The Owner, at the moment of accepting the Booking, enters into a Care Service Agreement with the Caretaker and agrees to pay the total amount indicated in the Booking. Payment must be completed before the start of the Care Service.
- The total amount paid by the Owner for the Booking corresponds to the price indicated by the Caretaker.
- The Caretaker acknowledges that the amount payable to the Caretaker for performing the Care Service is the Booking price reduced by the service fee charged by Animalhotels. The Caretaker gives unconditional consent to the deduction of the service fee by Animalhotels.
- Animalhotels charges a service fee from the Caretaker in the amount of 20% of the Booking value.
- When the Owner pays for the Care Service, they are required to provide the Payment Service Provider with valid and current payment card details or other payment information and keep that payment information (or another acceptable alternative payment method) saved in their Account, unless there are any outstanding confirmed reservations.
- The role of Animalhotels is to facilitate payments from Owners to Caretakers.
- Animalhotels is responsible for maintaining updated payment information.
- If the Payment Service Provider cannot charge the Owner on time because the payment information is no longer valid and/or the payment is not received on time, neither Animalhotels nor the Caretaker will be liable for any failure to perform the Care Service.

- The Caretaker offering their services through the Website and/or Application has the right to set their own refund terms depending on the time of cancellation. These terms may vary depending on the Caretaker and will be specified in the Offer description.
- The conclusion of an agreement for the provision of services within less than 14 days from starting the provision of services is tantamount to a request to perform the services before the expiry of the withdrawal period. In such a case, the User accepts that they have lost their right to withdraw from the agreement as soon as the Caretaker has fully performed the Service.
XIX. Reviews
- The Website and/or Application provide an opportunity for Owners to leave a subjective review of Caretakers and their Care Services.
- The Review may be posted after the Booking has been completed.
- The Review can only be published by a logged-in Owner who has made a Booking on the Website and/or Application and paid for it using the Payment Service Provider.
- The Review automatically appears on the Caretaker's Profile when it is posted by the Owner.
- The Review may not violate universally applicable laws, in particular it may not contain: profanity, untrue content, content which is defamatory or constitutes an act of unfair competition, advertising, data of Users or other natural persons, content which violates the rights of third parties, including intellectual property rights, good practices and personal rights, including the good name and reputation of other Users or third parties
